      Course description:

      El presente curso tiene como principal competencia/objetivo ofrecer a los estudiantes una visión de conjunto del Ordenamiento jurídico español. Desde la comprensión del origen histórico de las fuentes del Derecho, en particular desde los procesos decimonónicos de codificación, se abordan conceptos jurídicos básicos, el sistema normativo de fuentes y la organización político-institucional español. Las unidades temáticas están centradas en el estudio de los Derechos constitucional, civil, penal, procesal y mercantil, dedicando especial atención a la estructura y principios que informan la jurisdicción española. Las clases serán impartidas en español y están dirigidas a estudiantes que, teniendo conocimientos de lengua española, estén interesados en formase en el Ordenamiento jurídico español.

      La docente, Yolanda Quesada Morillas, es Doctora por la Universidad de Granada (España) e investigadora en la Cátedra del Prof. Czeguhn en la Freie Universität Berlin.

      Course description

      The international community as a whole and in particular the European Union, its institutions and its Member States have a role to play in addressing global migration challenges and refugee crises, including the 2015 EU migrant and refugee crisis and the 2022-2024 Ukrainian refugee crisis.

      This course provides an analysis of both the international and European regime of refugee protection. The module is divided into two parts. The first part covers the international legal framework for refugee protection. The course explores the basic provisions of the 1951 Refugee Convention and 1967 Protocol regarding the definition of refugee, the exclusion, cessation and ending of refugee status, the principle of non-refoulement, the required standards of treatment of refugees as well as the institutions tasked with overseeing the implementation of these instruments. Then, the course examines the refugee protection under international human rights law (European Convention of Human Rights).

      The second part of the course analyzes the development of the Common European Asylum System (CEAS) by the European Union. Within this framework, the course focuses on the issue of which Member State is responsible for examining the asylum claim (Dublin III Regulation), on the eligibility for protection (Qualification Directive), on the rules for the procedure for the examination of asylum claims (Procedures Directive) and on the conditions and rights applicable for asylum seekers pending the asylum procedure (Reception Conditions Directive).

      Descripción del curso:

      El curso tiene como finalidad la adquisición de competencias en el manejo de los contenidos fundamentales del Derecho Internacional Público en idioma español. En el mismo se desarrollarán los temas principales de esta materia, tales como concepto, tratados internacionales y otras fuentes, sujetos del derecho internacional -especialmente el Estado en el orden jurídico internacional y las organizaciones internacionales (Organización de Naciones Unidas)-, derecho del mar, derechos humanos, la responsabilidad internacional del Estado y del individuo, el uso de la fuerza en el derecho internacional y el derecho humanitario, entre otros. El curso se dictará totalmente en lengua española en clases participativas por lo que está dirigido a estudiantes con conocimientos a nivel de conversación en esa lengua.

      Der Kurs zielt darauf ab, Fähigkeiten bei der Behandlung der Kernthemen des Völkerrechts in der spanischen Sprache zu erwerben. Es werden die Hauptinhalte des Völkerrechts analysiert, wie z.B. Konzept, internationale Verträge und andere Quellen, die völkerrechtlichen Rechtssubjekte -insbesondere der Staat in der internationalen Rechtsordnung und die Internationalen Organisationen (Vereinte Nationen)-, das Seerecht, die Menschenrechte, die völkerrechtliche Verantwortung des Staates und des Einzelnen, die Anwendung von Gewalt im internationalen Recht und das Humanitäre Recht, unter anderem. Der Kurs wird vollständig in spanischer Sprache in partizipativen Einheiten gehalten, so ist er an Studierende gerichtet, die Kenntnisse auf Konversationsniveau in dieser Sprache bereits besitzen.

      Course description

      This course offers an introduction to the legal issues that non-U.S. lawyers may encounter as a result of their clients’ conducting business with U.S. parties. The instructor is a U.S. lawyer, who will teach from his deep practical experience in representing clients in international business transactions and dispute resolution. He will use lectures and interactive class discussions based on case law and statutory materials he will provide and also on hypothetical scenarios involving a European manufacturer confronting a variety of legal issues arising from the distribution of its products into the U.S. market. The course will include a gentle introduction to the case study and Socratic teaching methodologies used in U.S. law schools, which may be of special interest to students considering future study in the U.S.

      The course will cover the following topics:

      • A general overview of the U.S. Constitution, U.S-style federalism (specifically, the relationship between the U.S. federal and state governments) and other significant features of the U.S. legal system as relevant to international business law and dispute resolution
      • A survey of selected areas of U.S. substantive business law often involved in international business transactions and dispute resolution, including
        • Contract law
        • Corporate and bankruptcy law
        • Employment law
        • Product liability law
        • Certain U.S. statutory laws having extraterritorial effect including securities, antitrust (competition), the TREAD Act, foreign corrupt practices, and alien tort claims
      • U.S. civil procedure with particular emphasis on its application to international business litigation, including subject matter and personal jurisdiction, pleadings, service of process, class actions, pretrial discovery, early case resolution, trials, evidence, expert witnesses, available remedies, judgments and enforcement, and appeals
      • The U.S. approach to conflicts of law (private international law), as applicable to U.S. business law and dispute resolution
      • Alternative dispute resolution techniques commonly used for business disputes in the U.S., including arbitration, mediation and settlement

      This course will explore the laws governing and/or related to the Internet and various forms of technology and spans numerous interrelated topics such as free speech, privacy, reproductive technologies and other medical and technological “wonders.”

      While the course will draw extensively upon Anglo-American scholarship, legal texts, and case studies, it will also introduce different philosophical foundations of free speech and other relevant concepts as various as privacy, property, and personhood, with the goal of providing conceptual tools for students to examine the laws and case studies in their home jurisdictions.

      The subject's main objective is to allow the student to acquire a panoramic view of different legal systems, enriching the notion of law and demonstrating that the ways of conceiving and solving legal problems vary throughout the different legal systems, which allows visualizing the contingent nature of law and its understanding as a social and changing phenomenon.

      Course Description:

      International economic law is, on the one hand, a history of struggle both of individual actors competing in the marketplace of ideas for the best possible system of regulation and of industrialised and developing states entering the race towards their own share of global prosperity. While the critique of international economic law often revolves around its failures or inequalities in this story, there is also a narrative to be told of success in facilitating development and protecting both corporations and populations from abuse and exploitation. The course provides an overview and introduction into the regulation of three aspects of international economic relations: trade, investment, and finance. Thereby, it will contrast the evolution of the various features of each system with their current challenges. Starting out from the multilateral milestones achieved in international economic law, in-class discussions will address potentials for overcoming current stalemates and aberrations. The course will particularly focus on working with original material such as political proclamations, treaties, and case law.

      Das internationale Wirtschaftsrecht ist einerseits eine Erzählung des Strebens einzelner Akteure, die auf dem Marktplatz der Ideen um das bestmögliche Regulierungssystem konkurrieren, und des Wettlaufs von Industrie- und Entwicklungsländern um ihren Anteil am globalen Wohlstand. Während es der Kritik am internationalen Wirtschaftsrecht oft um Versäumnisse oder geht, finden sich auch Erfolgsgeschichten, die Entwicklung erleichtern und sowohl Unternehmen als auch ganze Bevölkerungen vor Missständen und Ausbeutung schützt.  Der Kurs bietet einen Überblick und eine Einführung in die Regulierung von drei Aspekten der internationalen Wirtschaftsbeziehungen: Handel, Investitionen und Finanzen. Dabei wird die Entwicklung der verschiedenen Merkmale jedes Systems mit den aktuellen Herausforderungen kontrastiert. Ausgehend von den multilateralen Meilensteinen, die im internationalen Wirtschaftsrecht erreicht wurden, werden im Unterricht Möglichkeiten zur Überwindung aktueller Blockaden und Fehlentwicklungen diskutiert. Der Kurs wird sich besonders auf die Arbeit mit Originalmaterial wie politischen Proklamationen, Verträgen und Rechtsprechung konzentrieren.

      Course content

      In this course, the topic of human rights will be explored from a legal perspective, but with a focus on current political debates about human rights and in particular with a view to the interrelationships of various human rights protection systems. Prior knowledge of the basics of public international law is welcome, but no requirement for participation.

      After an introductory session presenting an overview of the topics covered in this course, the main regional systems of human rights protection will be discussed, with a focus on the European Convention of Human Rights (ECHR). Two sessions will deal with the interrelationship of different human rights systems, including the EU Charter of Fundamental Rights, the ECHR and the international level. Further issues will be dedicated to international human rights regime (International Covenants on Civil & Political Rights & Social & Economic Rights). In the last part of the course we will deal with climate litigation as a human rights issue from a comparative perspective and welcome a guest speaker to talk about her experiences in human rights advocacy.

      Course description

      The course provides a general overview of the U.S. legal system. The course starts by introducing students to the legal education in the U.S. and the distinction between common and civil law jurisdictions. It continues by familiarizing students with the sources of U.S. law, both on the federal and state level, and taking a deeper dive into the U.S. Constitution as the foundation of the U.S. legal system, i.a., explaining the various methodological concepts of how to interpret the U.S. Constitution. The course will then address the U.S. court systems on both the federal and state levels with a focus on the U.S. Supreme Court and its jurisprudence. The course will also cover different material law topics from the U.S. legal system, incl. criminal and criminal procedure law as well as contract and tort law, in each case relying heavily on discussing relevant case law. The course is taught through a combination of lecture and in-class discussions and encourages active participation in order to acquire and practice legal terminology. In addition to the above topics the course covers select current issues from the U.S. legal systems, esp. notable trials, elections etc.
